Actually...no. That was for the sake of good business. But when you are instructed to read the EULA, and that clause is in it, it's saying "You are paying for a service that may or may not have unscheduled downtime for undetermined amounts, and waiving all rights that you, as a consumer, may have under the laws in your jurisdiction. "
In court, it functions to get the judge to say, "So you knowingly bought a service that has extended downtime, and now you're complaining that you did? This isn't their problem, it's yours. "

I have to say I don't disagree with this. It basically sets everyone's learning skills to 5 and hands everyone tons of SP that trained them. I could skill up an entire racial tier of ships with that.
The downside would be the skillramping you'd see happen for newer players.
